Statement of purpose of bill as introduced: This bill proposes to address certain applications of artificial intelligence in health and human services, including regulating mental health chatbots, requiring notice when generative artificial intelligence is used for patient communications relating to patient clinical information, and limiting the use of artificial intelligence in utilization review. The bill would provide neurological rights to individuals by creating privacy standards for neural data and by prohibiting electronic devices from bypassing the conscious decision making of individuals who have not provided consent. The bill would also modify the membership of the Artificial Intelligence Advisory Council, extend the Council’s duration until 2030, and require the Council and the Director of the Division of Artificial Intelligence
to report on the ethical and responsible use of artificial intelligence technology in healthcare, human services, and education.
